Throwing out the trash.... Empty Throwing out the trash....

One of the greatest challenges the patriot revolution has is how to correct the laws that are on the books that violate Constitutional guarantees. After knocking on doors and several I 'dont knows'. I got my answer.

There are 3 ways to remove a law that is in violation of the Constitution.

1) Civil disobedience... This is how the Civil Rights Movement was fought for quite some time. Plainly put you get arrested to for violating the law and get found guilty, appeal to the state appeals court, then the USASC. The problem with this is that you stand to lose everything you own and that your family will forever be part of the rubble. Just ask any Civil Rights advocate that is still around.

2) Petition... This is where you write up a Bill and get a senator or representative to sponsor it. Then you go out and drum up the votes by knocking on doors of the rest of the state legislators. By far this is the least impact method. Problem is you have to get a large enough group to knock on enough doors to push it through. If it gets through and wins enough votes to get put on a state ballot then the really hard work begins to reach the voters on why this needs to be done.

3) Run for the office of SAG(State Attorney General).... again it requires a dedicated group of individuals who are not afraid of publicity and talking to everyone. From this group an individual should be selected as a candidate and literally everyone talks them up and campaigns to get their name on the ballot and win the votes of the voters. Once in place this individual can investigate the legislation on the books and call for hearings on the matter. This indivdual will need the support of the campaign group to assist in researching for cases that create precedent and which might give support to repealing the legislation.

The only thing I see about all this is that 2 and three require a HUGE amount of money. Everyone involved should be debt free and clear backgrounds. It would require about 10 people from every county to begin the elbow rubbing and campaigning.

So there you have it. Put your walking shoes on.

You missed the most common way. Challenge the law in question in the court. This requires 4 basic things.

First, an injured party. To file a lawsuit, you must have someone who has been injured by that law..for example, Mr. Heller in the Heller vs DC supreme court case.

Second, a lawyer willing to take the case. The lawyer involved determines, partially, how much of the next thing you need.

Third, Money. The lawyer charges his/her fees of course, but there are also significant costs involved for court fees, printing and copying, possible investigative work, depositions, etc. The lawyer can control only their direct fees.

Fourth, patience. Lots of patience. On average, you can plan on at least 2 years for this to run it's course, and 3 years or more is not unusual.
